Terms of Service

The rules and guidelines for using the Mifugo platform.

1. Agreement to Terms

By accessing or using the Mifugo platform ("Service"), operated by MifugoApp ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By creating an account, you represent that you meet this requirement and have the authority to enter into these Terms.

2. Description of Service

Mifugo is a livestock management platform that helps small-scale farmers track their animals, feed, production, health, sales, and profitability. The Service includes:

  • Web application at app.mifugo.app

  • Mobile application (Mifugo Go) at m.mifugo.app

  • API access for integrated services

  • Related features, tools, and support

    • We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We are not liable for any interruption or discontinuation of the Service.

    3. Account Registration & Security

    To use the Service, you must create an account. You agree to:

  • Maintain the security of your password and account credentials

  • Notify us immediately at [email protected] if you suspect unauthorised access to your account

  • Accept responsibility for all activity that occurs under your account

    • You may not share your account credentials with others or create multiple accounts for the same organisation. We reserve the right to suspend or terminate accounts that violate these Terms.

    4. Acceptable Use Policy

    You agree not to use the Service to:

  • Infringe on the rights of others, including privacy and intellectual property rights

  • Upload or transmit malware, viruses, or any harmful code

  • Attempt to gain unauthorised access to the Service, other accounts, or connected systems

  • Interfere with or disrupt the Service or servers

  • Use the Service for competitive benchmarking or to build a competing product

  • Scrape, crawl, or use automated tools to extract data from the Service

  • Send unsolicited communications (spam) through the Service

  • Impersonate another person or entity

    • 5. User Content & Data

    You retain ownership of all data, information, and content you submit to the Service ("User Content"), including farm data, livestock records, financial information, and any other materials.

    By using the Service, you grant us a limited, non-exclusive licence to use your User Content solely for the purpose of providing and improving the Service. This licence ends when you delete your account, except for copies retained in backups (which are deleted within 90 days).

    We will never use your farm data for advertising, sell it to third parties, or share it with other users without your explicit consent.

    6. Data Ownership & Portability

    Your data belongs to you. We claim no ownership over your farm data, financial records, or any other information you enter into the Service.

    You may export your data at any time through the Service. Upon account deletion, we retain your data for 30 days to allow recovery, after which it is permanently deleted from our active systems and removed from backups within 90 days.

    7. Intellectual Property

    The Service, including its design, code, features, trademarks, and documentation, is the intellectual property of MifugoApp. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose.

    You may not copy, modify, distribute, sell, or lease any part of the Service or its associated software without our prior written consent.

    8. Payment & Billing

    The Service offers free and paid subscription plans. By selecting a paid plan, you agree to the following:

  • Subscription fees are billed in advance on a monthly or annual basis, depending on your chosen interval.

  • All prices are displayed in Kenyan Shillings (KES) and include applicable VAT (16%).

  • Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.

  • You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period.

  • If a payment fails, we will attempt to retry the charge. If payment cannot be collected within 7 days, your plan may be downgraded.

    • Refunds are handled on a case-by-case basis. If you believe you are entitled to a refund, contact us at [email protected] within 14 days of the charge.

    9. Service Availability

    We strive to keep the Service available and reliable, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Unforeseen technical issues or outages

  • Events beyond our reasonable control (force majeure), including natural disasters, government actions, or infrastructure failures

    10. Limitation of Liability

    To the maximum extent permitted by law:

    The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

    In no event shall MifugoApp, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

    Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

    11. Termination

    You may terminate your account at any time by contacting us at [email protected] or through the account settings.

    We may suspend or terminate your account if you violate these Terms, with or without prior notice. Upon termination:

  • We retain your data for 30 days to allow recovery

  • After 30 days, your data is permanently deleted

  • Certain provisions of these Terms that by their nature should survive termination will survive (e.g. intellectual property, limitation of liability, dispute resolution)

    • 12. Dispute Resolution

    These Terms are governed by and construed in accordance with the laws of Kenya. Any disputes arising from or related to these Terms or the Service shall be resolved in the courts of Kenya.

    Before filing a formal dispute, you agree to first contact us at [email protected] and attempt to resolve the matter informally. We will endeavour to resolve disputes within 30 days of receiving your notice.

    13. Modifications to Terms

    We may update these Terms from time to time. When we make material changes, we will notify you by email or through a prominent notice on the Service at least 30 days before the changes take effect.

    Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you may terminate your account before the effective date.

    14. Miscellaneous

  • Entire agreement — These Terms, together with our Privacy Policy, constitute the entire agreement between you and MifugoApp regarding the Service.

  • Assignment — You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations without restriction.

  • Waiver — Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
